FHBA Model Contracts Updated to Reflect Change in Statute of Repose Law

Once the Governor signed the Statute of Repose Bill, FHBA Senior Officers had two immediate requests. First, update our model contracts to address the changes. As a result, FHBA worked with a Board Certified Construction Attorney to revise the model contracts in an effort to address the most recent changes to Florida’s Statute of Repose Law. Secondly, the Senior Officers asked that FHBA capitalize on the Governor’s promise to support future legislation addressing the law’s uncertainty with respect to residential contractors. The crux of the issue concerns the time when the statute of repose begin to toll. The bill signed into law provides clarification for commercial contractors, but we continue to stress it created more uncertainty for residential contractors. Henceforth one of our 2018 Legislative priorities is to fix the uncertainty created by last year’s bill.

Sen. Passidomo (R-Naples) agreed to sponsor the glitch legislation in the Senate while Rep. Tom Leek (R-Daytona Beach) will work on our behalf in the House.

Protect yourself by reviewing (or have your attorney review) the revised FHBA model contracts. The one’s specifically revised are:

  • Standard Construction Contract on Builder’s Property
  • Residential Builder’s Agreement
  • Standard Construction on Owner’s Property
  • Standard Remodeling Contract
